General terms and conditions (GTC) for city tours

The following conditions apply to the booking and implementation of city tours for groups that are individually organized by city tours Weimar (hereinafter referred to as “organizer”) and are exclusively walking tours led by a licensed city guide.

These conditions form the basis of every contract for guided city tours. Contract partner of the customer is:

1. Scope

These general terms and conditions apply to the business relationships between city tours Weimar and their customers. The General Terms and Conditions of City Tours Weimar also apply if City Tours Weimar confirms a booking by the customer with knowledge of the customer's terms and conditions. City tours Weimar only recognize conflicting, deviating or supplementary terms and conditions of the customer by expressly agreeing to their validity in writing.


2. Conclusion of the contract

a) Concrete bookings of city tours for city tours Weimar must be made in writing or by email. The booking is to be understood as a binding declaration of intent by the customer.

b) A contract with City Tours Weimar only comes into existence when City Tours Weimar has confirmed the customer's booking in writing or by email ("order confirmation").

c) All changes to a binding booking are also recorded exclusively in writing or by email.


3. Scope of services

a) The contractual service results from the service description as well as the services additionally listed in the booking confirmation. Ancillary agreements that change the scope of the contractual services require express written confirmation.

b) The organizer expressly reserves the right to change the information if it is necessary for unavoidable reasons. The overall layout of the agreed city tour must not be impaired. The customer will be informed immediately by the organizer.

c) The tours are on foot, all sights are usually explained from the outside. The city tours are accepted and confirmed with a number of up to 25 participants. At the request of the customer, more than 25 people can take part in the city tour, provided that this does not affect the quality of the city tour. If this is not possible, the customer is entitled to call in an additional city guide.

d) All information as well as the descriptions of the city tours in brochures, on the Internet, etc. are only examples of generally possible services. This does not guarantee any specific content for the city tours. City tours Weimar only owes the scope of services expressly stated in the order confirmation.


4. Services not used

If the customer does not make full use of individual services after the start of the journey due to an early return or for other reasons, he is not entitled to a reimbursement or reduction in the price.


5. Cancellation of the contract

If the tour is made considerably more difficult, endangered or impaired as a result of force majeure that was not foreseeable when the contract was concluded, both the organizer and the customer can terminate the contract. If the contract is terminated, the organizer can demand appropriate compensation for the services that have already been performed or those that are still to be performed by the end of the tour.


6. Cancellation

a) The customer can withdraw from the contract. Cancellation free of charge is possible for the customer up to the 30th day (Mon-Fri except on public holidays and on December 24th and December 31st) before the agreed contractual service. The withdrawal becomes effective on the day on which it is received by the organizer. The customer must declare the withdrawal in writing. The organizer expressly reserves the right to invoice the customer for services already provided on behalf of the customer.

b) If the customer withdraws after the 30th day before the agreed contractual service, the following fees apply:

25% of the valid price from the 29th to the 7th day before departure
from the 6th to 3rd day before departure, 50% of the valid price
from the 3rd day before departure 90% of the valid price.

c) If an agreed tour is not used without a written or oral cancellation by the customer at least three calendar days before the agreed date, the customer will be charged a cancellation fee in the full amount of the agreed fee.


7. Payment

a) For the contracts, the prices of the company valid at the time the contract is concluded apply, unless otherwise agreed in an individual contract.

b) Unless otherwise agreed in writing, the price will be paid to the tour guide by the customer or his agent directly before the tour, in cash, by EC or credit card, unless otherwise agreed. A receipt will be sent to you by email.

c) If the billing address is outside of Germany, the customer usually has to pay in advance. Payment is made in advance by credit card or PayPal.

d) If the customer's credit card is unsuccessful (e.g. because the credit card details provided by the customer are incorrect or insufficient funds are available), City Tours Weimar - in addition to their right to refuse service - is also entitled to withdraw from the contract.

e) If advance payment was made by credit card and there is a difference in favor of the customer after the services have been performed (e.g. if a tour guide is ill), the customer will be reimbursed this difference via the credit card. If, after the services have been performed, the customer still has outstanding payments, the customer will be billed for the services that have not yet been paid and the credit card specified will be charged accordingly.

f) The tour guide is obliged to wait 30 minutes from the beginning of the agreed time of the tour. If the guests to be guided arrive late, it must be agreed between the guests and the tour guide whether - if the tour guide has to fulfill other obligations - the tour will be shortened or whether the originally agreed duration can be realized.

g) If the tour is shortened, the agreed fee is due in full.

h) If the customer wishes the city guide to extend the service while the service is being provided, the city guide has the right to demand a correspondingly higher fee. The same applies if the contractually agreed amount of time is exceeded by more than 30 minutes at the customer's request. In this case, a lump sum of 30 euros (<30 minutes) or 50 euros (<60 minutes) applies.


8. Exclusion

The customer's right to submit claims to third parties arising from the contract is excluded. The customer is also not entitled to authorize a third party to assert his claims in his own name.

9. Duty to cooperate
The customer is obliged to cooperate within the framework of the statutory provisions in the event of service disruptions, to avoid possible damage / disruptions or to keep them to a minimum. In particular, the customer is obliged to notify the organizer of any complaints immediately. Claims for non-performance or performance not in accordance with the agreement must be made in writing to the organizer within one month of the contractually stipulated end of the tour. Claims by the customer expire after 6 months. The statute of limitations begins on the day on which the city tour should end according to the contract.


10. Liability

a) The organizer is liable within the scope of the due diligence of a prudent businessman for the conscientious preparation and implementation of the city tour in accordance with the agreed contract.

b) The organizer is liable for damages within the framework of the statutory provisions in the event of intentional or grossly negligent behavior.

11. Scope and jurisdiction
a) The following conditions apply exclusively to all initial, current and future transactions to be concluded / concluded with the organizer. The organizer does not recognize conditions of the client that differ from these general terms and conditions. These do not become part of the contract even if the organizer does not expressly contradict them.

b) By placing the order, the customer accepts the exclusive validity of these terms and conditions.

c) The place of performance and place of jurisdiction is Weimar, as far as legally permissible. However, the organizer is entitled to assert claims against the client at any other court responsible for this.

d) German law applies to the conclusion of contracts.


12. Final provisions
The ineffectiveness of individual provisions of the contract does not result in the ineffectiveness of the entire contract.
The orderer of a service accepts these general terms and conditions with the order / booking confirmation to city tours Weimar.


13. Severability Clause

If individual provisions of these terms and conditions are or become ineffective, this shall not affect the validity of the remaining provisions.
